"The Buyer" means the person with the highest bid accepted by the auctioneer
"The lot" means any item deposited with us for sale at auction and, in particular, the item or items described against any lot number in any catalogue.
"The hammer price" means the amount of the highest bid accepted by the auctioneer in relation to a lot.
"The Buyer's premium" means the charge payable as a percentage of the Hammer Price.
"The Reserve" means the amount below which we agree with the Seller that the Lot cannot be sold.
"Forgery" means a Lot constituting an imitation originally conceived and executed as a whole with a fraudulent intention to deceive as to authorship, origin, age, period, culture or source where the correct description as to such matters is not reflected by the description in the catalogue and which at the date of the auction had a value materially less than it would have had if it had been in accordance with the description in the catalogue. Accordingly, no Lot shall be capable of being a Forgery by reason of any damage and / or restoration work of any kind (including repainting).
Descriptions and estimates
The estimated prices printed below the catalogue descriptions are the approximate prices expected to be realized, excluding Buyer's premium. They are not definitive. They are prepared well in advance of the sale and are subject to revision. Estimates of the selling price should not be relied on as a statement that this price is either the price at which the Lot will sell or its value for any other purpose.
Catalogue illustrations are for guidance only, and should not be relied on either to determine the tone of color of any item or to reveal imperfections.
Statements by us in the catalogue or condition report, or made orally or in writing elsewhere, regarding the authorship, origin, date, age, size, medium, weight, attribution, genuineness, provenance, condition or estimated selling price of any Lot are merely statements of opinion, and are not to be relied on as statements of definitive fact
The origin of the goods is based on the seller's good faith. Therefore, we cannot be held responsible in this regard.
Before the Sale
The Lots will be exposed for viewing three days prior to the auction at the dates indicated in the catalogue.
Prospective buyers are strongly advised to examine personally any goods in which they are interested, before the auction takes place. No complaint will be allowed after the fall of the hammer. We provide no guarantee to the Buyer other than in relation to Forgeries, as explained in clause 1-f.
Any modification to the conditions of sale or in the content of the catalog will be announced by the Auctioneer during the auction.
Bidding
To place a bid, you must raise your hand or a numbered plate that will be given to you at the beginning of the auction to allow the auctioneer to take your bid during the auction. We strongly recommend you to take a plate number before the auction to facilitate the bidding process. Please bid clearly using your numbered plate or hand and promptly.
Bids are usually advanced at 10% increments, e.g. US$ 200, US$ 220, US$ 250 etc. But we remind you that the auctioneer does have absolute discretion as to the way he increases the bids.
In order to facilitate the transactions, the estimates and the bids will be given in US Dollars.
The highest and last bidder is the Buyer.
Should any dispute arise in regard to bid result at the fall of the hammer, the lot in dispute will immediately be put up again for re-bid for all participants.
Upon the fall of the hammer, the Buyer will sign an obligation form that will be handed over to him.
Payment
Bellamy's is acting on behalf of a third party. Therefore, no delivery will be made before the full settlement of the total amount.
In addition to the Hammer Price, the Buyer must pay our Buyer's premium equal to 10% of the hammer price and the Municipality Tax of 2.5%.
The buyer must also pay the VAT (value added tax) equal to 10% of the buyer’s premium in addition to the Municipality tax therefore : 10% of (10% + 12.5%) = 1.25%
A 50% down-payment for each lot purchased must be paid at the end of the auction. The payment will be made in Lebanese Pounds or in US Dollars at the daily current exchange rate.
Payment is accepted in cash, cheque or credit card (Visa / MasterCard). Credit Cards payments will be charged an additional 2.75% fee.
Deliveries
The buyers must take delivery of the merchandise, after full settlement, within a maximum of 4 days from the auction date. The Buyer that do not do so will have to bear the insurance and warehousing fees for the goods for a period not exceeding 15 days. Following this period, the sale will be considered void and the down-payment will remain our full property.
X company has a representative on our premises and will be pleased to provide Buyers with estimates for deliveries. Alternatively, clients can make their own arrangements. For any information, please contact us, or see the "clientele desk" at the end of the auction.
Restrictions
Overseas buyers, please ensure that you are aware of any restriction or license requirements for your intended purchase. If you are unsure, please contact your local custom authorities.
Other
We are not responsible for the correctness of any statement as to authorship, origin, date, age, attribution, genuineness or provenance of any Lot nor for any other errors of description or for any faults or defects in any Lot .
